Transfer Policy

1. Transfer of Licence of Built-up Shops / Commercial Spaces

Srinagar Development Authority has liberalized transfer policy of its Commercial Assets, which have been transferred by the allottees without the prior permission of the Srinagar Development Authority. The following requirements for transfer of such Commercial Assets are to be fulfilled by the interested applicants. Production of Documents. The documents duly attested evidencing the transfer of leasehold rights/ licence by the original allottee to the applicant i.e. copy of power of attorney, copy of agreement, copy of partnership deed, Copy of dissolution deed. Copy of receipt of consideration or any other document where under the property has been taken possession of. Copy of Permanent resident certificate. Specimen signatures and passport size photograph duly attested by 1st Class Magistrate / Gazetted Officer NOC regarding payment of premium/ rent / ground rent of the shop/site from the Asstt. Rev. & Reh Officer, Srinagar Development Authority to the effect that no premium /rent or ground rent is outstanding. Copy of 1st page of Ration Card of the applicant or electric or water connection bill or last telephone bill duly attested as proof of the residence Copy of original documents issued by the SDA to the original allottee viz lessee/ licencee. Affidavit to the effect that the applicant has been in continuous possession of the shop/commercial space/site from the date the shop/ commercial space/sit has been obtained from the original allottee to whom the applicant has paid all dues on surrender of possession personally. On clearance of the case for transfer, the desirous applicant is required to pay transfer fee equivalent to 10% of the present rate of premium and shall surrender all the original documents in this behalf. The rate of premium is determined on the basis of the Commercial Assets sold in the area during the year or where no such details are available, the rate is determined on the basis of the personal enquiry by the Committee constituted for the purpose. 2. Transfer of Lease of Shopsites and Residential Plots. Srinagar Development Authority has liberalized transfer policy of its Residential Plots, which have been transferred by the allottees without the prior permission of the Srinagar Development Authority. The following requirements for transfer of such Residential Plots are to be fulfilled by the interested applicants. Production of Documents. The documents duly attested evidencing the transfer of lease hold rights by the original allottee to the applicant i.e. copy of power of attorney and copy of agreement. Copy of receipt of consideration or any other document where under the property has been taken possession of. Copy of Permanent resident certificate. Specimen signatures and passport size photograph duly attested by 1st Class Magistrate / Gazetted Officer NOC regarding payment of premium / ground rent of the plot from the Asstt. Rev. & Reh Officer, Srinagar Development Authority to the effect that no premium / ground rent is outstanding. Copy of 1st page of Ration Card of the applicant or electric or water connection bill or last telephone bill duly attested evidencing the occupation of the plot for which the transfer is sought. Copy of original documents issued by the SDA to the original allottee viz lessee. Affidavit to the effect that the applicant has been in continuous possession of the plot from the date the plot has been obtained from the original lessee to whom the deponent has paid all dues on surrender of possession personally. The applicant shall furnish an indemnity bond against any claim from any person in respect of transfer of plot in question pursuant to notice, the applicant shall file an indemnity bond on non-judicial paper of Rs. 40.00 duly attested by the Magistrate 1st Class. (Note: all the original document shall have to be furnished by the applicants before the formal transfer orders is issued) On clearance of the case for transfer, the desirous applicant is required to pay transfer fee of Rs.10.00 per sft (Rupees Ten Only per sft) and surrender all the original documents.
